My Car Was Towed! What Can I Do?

When you park your car in a privately-owned parking lot, like those at shopping plazas and apartment complexes, you are subject to the policies and rules the owners of those lots choose to establish. However, in Florida, state laws are in place to help protect consumers.

Most importantly is the notice requirements. For a nonconsensual towing in Florida to be legal, there must be adequate signage at every entrance and exit. The notice must display “TOW-AWAY ZONE.”  If the parking lot does not meet the stringent notice requirements, then a tow without the consent of the owner is wrongful, improper, and illegal.

If there was proper signage, then you just learned an expensive lesson. Pay the towing company the fee and pay more attention when choosing a parking lot in the future. However, if any entrance is not properly marked with a sign stating “TOW-AWAY ZONE,” we want to know about it because we can help.

Upon discovering that your car is missing, you should check with local law enforcement to see if your vehicle has been stolen or towed. A tow truck company must notify the local law enforcement agency within 30 minutes of completing the tow. The tow truck company must report the time of the tow, the location the vehicle’s impounding, and description of the car. The vast majority of tow truck drivers understand the importance of this to comply with state law.

Once you have determined that your car has been towed, retrieve your vehicle – don’t delay. If the vehicle is not retrieved within a set amount of time, the tow company may charge additional storage fees. You will need to take with you proper identification to prove ownership and cash. The vast majority of tow companies do not accept other forms of payment. We also recommend that you get a receipt and keep it. Even if you believe that the tow was wrongful, delaying to retrieve your vehicle will not help.

If you believe that the towing of your vehicle was wrongful, photographic evidence is critical. From a safe location, take pictures of the entrance of the lot and any signs or the lack of signs. Wide-angle images work best. Without photographs, we will most likely not be able to help.
